MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY, DECEMBER 17, 2009
3:P.M.

PRESENT:        Dr. James Taylor, Vice-Chairman,  Dr.Lois Roth-Johnson, Beverly Knox, R.N., B.S,   Pat Lariviere, R.N., Jane Crowley, M.S., R.S., Health Agent, Sue Barker, Assistant Health Agent, (Stan Holt, Chairman-absent)

Dr. Taylor, Vice-Chairman opened the meeting at 3: p.m.

OPENING STATEMENTS:

1.      In November a Regional H1N1 clinic was held including the Town of Brewster, Eastham.,Wellfleet and Truro.  Jane Crowley updated the Board about the H1N1 flu clinics which were held this month.   December 7 the H1N1 clinic was held at the elementary school and December 10 the H1N1 clinic was held at the Nauset Regional High School, both clinics were very successful.  On December 15, the seasonal flu clinic was held at the Council on Aging which had a high turn out.


2.      Environmental Partners continue with on site well information.  



VARIANCE:

1.      First Horizon Home Loans        2470 State Highway      Map-15 Parcel-65

Tim Brady (East Cape Engineering) submitted revised site plan dated
October 30, 2009 for the property at 2470 State Highway showing the installation of a sewage disposal system for a residential condominium project currently under construction.  The Board of Health reviewed and approved the         revised septic system plan using Advantex AX Model 100 Technology.

        The revised plan includes modifications to the original disposal system design.
        The proposed modifications to the septic system design are as follow:
1.      The soil absorption system has been moved 10ft further from the existing foundation to provide the minimum 20ft. setback set forth under 310 CMR 15.211.
2.      The zone 1 public water sypply radius has been reduced from 193ft. to 171ft. which reflects the reduction in daily flow from 4070 gpd (37 bedrooms) to 2970 gpd ( 27bedrooms)
3.      The size of the soil absorption system has been reduced an additional  3% for a total reduction of 40%, (37% was originally approved). At this size, the soil absorption system will be located outside the Zone 1 radius of the public water supply well.

The Board approved the revised plan which represents an environmental improvement and provides nitrogen reduction technology with the following conditions:

        1.      Routine water quality test results be provided of existing well location to assure potability.
        2.      No increase in design flow be allowed.
        3.      Secondary treatment and monitoring under remedial use approval conditions per DEP regulations including testing quarterly for total     nitrogen, BOD, TSS, Nitrate-nitrogen not to exceed 19mg/ml.  After 2 year period of operation reduction of testing could be             requested to the BOH by the owner. Operator will be required to submit results via the web based Carmody Data base system               operated by Barnstable County Department of Health and Environment (when the data base is available) or provide reports to               Eastham Board of Health.
        4.      Operation and maintenance agreement to be submitted to Eastham Board of Health for the life of the system.  Operation and               maintenance agreement to be required for the life of the system
        5.      Deed restriction for 27 bedroom use and use Advantex AX 100 technology requirement to be recorded on deed.  
        6.      Designer to verify proper operation of the system prior to issuance of the Certificate of compliance.
        7.      Routine DEP approval of reclassification of PWS and resulting Zone 1 radius of 171ft.
        8.      Condominium agreement should be provided that will detail ownership responsibilities related to operation and management of the         septic system and shared facilities prior to occupancy.
        9.      The Board of Health shall require escrow funds to cover operational costs and possible repairs that might become necessary.  Town       council should review and approve any such agreement  prior to approval.

        Dr. Lois Roth-Johnson made the motion to approve the revised plan with the 9 conditions.
        Beverly Knox seconded the motion.
        SO VOTED UNANIMOUSLY


VARIANCE CONTINUED FROM  OCTOBER 22, 2009
        
2.      David White     485 Bridge Road         Map-20   Parcel-72A

        David Lajoie (Felco Engineering) came before the Board  to update the Board about the preliminary sketch plan for 485 Bridge Road. This plan will come before the ZBA on February 11, 2010.  Mr. Lajoie will submit an alternate plan to reduce the shape and increase the width of the panhandle. There was no vote on the plan since it must go before the ZBA for approval.

REVIEW

3.      Pine Tree Builders      5 Lighthouse Lane     Map-9     Parcel-383A
        (Leslie Riordon)

David Lajoie (Felco Engineering) submitted a request for provisional use approval utilizing     the Advantex-AX 20 technology.   The plan was approved with the following conditions:

1.      Routine water test from existing well location to assure potability.
2.      No increase in design flow be allowed.
3.      Secondary treatment and monitoring under provisional use approval
conditions per DEP regulations including testing quarterly for total nitrogen,  BOD, TSS, Nitrate (or 2 times per year for seasonal use).  Effluent nitrate-nitrogen not to exceed 19mg/1.
4.      Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system.  Operator to report results via Carmody Data Base provided through the Barnstable Health or directly to the Eastham Health Department if not available.
5.      Deed restriction for 3 bedroom use and use Advantex AX 20 alternative technology requirement to be recorded on the deed.
6.      Designer to verfify proper operation of the system prior to issuance of the Certificate of Compliance.  
7.      Any increase in Habitable square footage would require board of health review and abutter notification.
8.      Contingent on all conditions required under DEP approval for provisional use, using Advantex AX 20.

        Pat Lariviere made the motion to approve the plan with the 8 conditions.
        Beverly Knox seconded the motion.
        SO VOTED UNANIMOUSLY



V.      HARRIS FAMILY REALTY TRUST - AND EASTHAM DOG OWNERS ASSOCIATON

4.      Carl W. Harris  23 Keene Way    Map-19    Parcel-43J

Mr Harris came before the Board seeking support for the elimination of allowing dogs on his property north of Dyer Prince Beach.
Attorney Dwight Landry representing. Mr. Harris informed the Board that the regulation passed by the Board of Selectmen on March 13, 2000 regarding the dogs at Dyer Prince /Rock/ Harbor is being seriously ignored.

5.      Mr. Edward Daniels, Vice President of the Eastham Dog Owners Association and Martin  Hasbel a board  member of the association          came to BOH meeting to discuss the dog issues relative to the use of the Dyer Prince beach.
        
        Dr.Taylor stated he would send a letter to the Board of Selectmen concerning the enforcement of the current regulation and require that         the dogs be on a leash at all times.

        Food Establishments-Swimming Pools -Whirlpools
        Septic Haulers-Septic Installers-Refuse Haulers
        Manufacture Ice Cream-Milk and Cream - Tobacco
